| Anti-corruption rules in sectoral legislation - is the placement of the legal regulations that have an anti-corruption focus, codified in various regulations. Codified law or codified normative act relates to sectoral legislation. Branch of the legislation - is a reflection of the normative branch of law. Branch of the legislation in its content has something branch of law. Branch of law - a set of legal norms and institutions that govern a particular area of public relations. Accepted provide the following branches of law: constitutional, civil, civil procedure, administrative, criminal, criminal procedure, penal, labor, family, financial, tax, land, environmental, social security law, and others.
Directly related to the anti-corruption sectoral legislation have the following codes, standards which provide for legal responsibility for corruption offenses: - The Civil Code of the Republic of Kazakhstan - adopted on 27 December 1994; - The Code of Administrative Offences of the Republic of Kazakhstan - adopted July 5, 2014 (№235 - V - SAM); - Criminal Code of the Republic of Kazakhstan - adopted 3 July 2014 (№226-V); - On taxes and other obligatory payments into budget (Tax Code of the Republic of Kazakhstan) - adopted on 10 December 2008. In the legal system occupy a special place regulatory decisions of the Supreme Court of the Republic of Kazakhstan. Regulatory decisions of the Supreme Court - is an integral part of the law in the Republic of Kazakhstan. Their main purpose is to provide clarification to the courts on issues of judicial practice. They are required when making decisions on the courts emym We considered their cases. By the regulatory decisions of the Supreme Court of the Republic of Kazakhstan for combating corruption include: - On some issues of qualification of crimes in sphere of economic activity - June 18, 2004; - On the practice of courts of criminal cases on crimes related to corruption - from December 13, 2001 №18; - On the practice of courts of legislation on liability for bribery (as amended by Resolution of the Plenum of the Supreme Court of the Republic of Kazakhstan dated December 20, 1999 №20) - on December 22, 1995 №9. жүктеу/скачать 2,07 Mb.
