1. METHODOLOGY
Preliminary examination of the Bakyrchik mine site and surrounding area (hereinafter together referred to
as the Area) was undertaken on the basis of topographic maps, satellite images, scientific literature and
historical and cultural heritage regulatory documents (including State list of historical and cultural
monuments of local importance, approved by Decree 560 of East Kazakhstan Regional Akimat of 25 April
2008 and the State List of historical and cultural monuments of national significance, approved by Decree
279 of the Government of the Republic of Kazakhstan dated 21 March 2008).
In August 2013 a team of specialists (Vitaly Shuptar, Alexander Novikov and Evgeny Ermolyonok) carried out
a full-scale field surveys to confirm the presence or absence within the Area of monuments of historical and
cultural value. The walkover examination included only visual inspection of areas without any archaeological
work. The walkover survey was preceded by panoramic site inspection using optical instruments (binoculars)
from heights (hills and dumps). Surveys were carried out with the use of photographic images and satellite
equipment (GPS-receivers).
As a result of the field work, the immediate mine site was examined together with a 1,000-meter surrounding
area. The total survey area was 35.9 km
2
. The Area layout is contained in Annex 1 (for more precise
information on the whereabouts of objects see attached file AvalonHGS_BakyrchikReport_GPS.kmz being
also Annex 2).
2. OVERVIEW OF CULTURAL HERITAGE PROTECTION LAW
In accordance with Article 5 of Act 1488-XII of the Republic of Kazakhstan "On protection and use of Historical
and Cultural Heritage" of 2 July 2, 1992 (the main legal document document governing this area), objects of
historical and cultural heritage acquire the status of monuments of history and culture after they are
recognized as such in the manner prescribed by the Act. This involves quite lengthy and complicated
procedure described in the Guidelines for Identification of Cultural Heritage Sites and Granting and
Withdrawal of Status of Historical and Cultural Monuments, approved by Decree 1032 of the Government of
the Republic of Kazakhstan dated 2 November 2007, as well as the Historical and Cultural Examination

Guidelines approved by Order 219 dated August 20 2007 of the Minister of Culture and Information of the
Republic of Kazakhstan.
In accordance with the above-mentioned legal acts, the identification of historical and cultural heritage
should be provided by local executive bodies (in case of Bakyrchik, this is responsibility of the Akimat of East
Kazakhstan region and a direct responsibility of East Kazakhstan Regional Institution for Protection of
Historical and Cultural Heritage of the Department of Culture of East Kazakhstan Oblast). The Research work
on the basis of which the identified objects are included into the Pre-Registration List should be carried out
by an organization or experts licensed for archaeological and (or) conservation work on historical and cultural
heritage sites. Based on the conclusion of such an organization or an expert local agencies are preparing a
detailed justification, which, after consultation with the competent authority (the Ministry of Culture and
Information), is the basis for inclusion (or non-inclusion) of the object into the state list of historical and
cultural monuments of the corresponding level (international, national or local, ie regional). On that basis,
the monument either falls or doesn’t fall under the state protection. It should also be noted that the
identified sites of historical and cultural heritage included into the list of pre-registration by the competent
state bodies, even before being granted final status should be protected equally with historical and cultural
monuments.
Monuments of History and Culture in the Republic of Kazakhstan are subject to mandatory protection and
preservation and as such have a special legal regime of their use, change of ownership and depriving them
of their status. So, for example, an owner may have the right of possession, use and disposal of historical and
cultural monuments, as an object of property, except for the right of destructing it. At the same time, the
owner (and the tenant) have a number of responsibilities set out in Article 13 of the Act, including the
obligation to ensure the preservation of monuments of history and culture, access to the monument of
history and culture in scientific, cultural and other purposes in the manner and within the established special
agreements with the local executive bodies of the regions, as well as several others. According to Article 34
of the Act, research and restoration work on the monuments of history and culture should be financed from
the State funds, by investors, as well as the owners and tenants. At the same time, the legislation does not
define in which cases which sources are to be used. In practice, however, such work is usually carried out at
the expense of the owner or tenant of the territory where the monuments are located.
3. GENERAL CHARACTERISTICS OF THE REGION
Archaeological research in East Kazakhstan trace their history from the middle of the XVIII century (Miller,
Sievers), however, systematic work in this area began only in 1935 with the foundation of East-Kazakhstan
Archaeological Expedition led by S.S.Chernikova that, without focusing of any particular era, was engaged in
research of all archaeological sites without exception. The results of years of work of the East-Kazakhstan
Archaeological Expedition were reflected in the archaeological map of Semipalatinsk and East Kazakhstan
regions.
The vast majority of archaeological sites in East Kazakhstan is concentrated in the vicinity of major rivers,
including the Irtysh River and its major tributaries. Most significant of them, such as Kanay, Ust-Narym,
Malaya Krasnoyarsk and Trushinkovo (settlements and cemeteries) are localized along the Irtysh River. These
historical monuments were located at the most adjacent to the large and easily accessible to the ancient man
deposits of copper, tin and gold, as evidenced by traces of ancient mine workings.
Speaking directly about Zharma area, the largest localization of historical and cultural monuments (to a
greater extent, we are talking about the Bronze Age and early Iron Age) is also observed along the major
rivers, particularly in the vicinity of the following settlements: Zharma village, the village Kriushi, wintering
Tuma and Karazhal and near Lake Karakol. From places that attract the attention of archaeologists in recent
years, it is possible to mention the mountains Delbegetey (north-western part of the district), where a large
number of petroglyphs and tin mines of the Bronze Age and the Turkic stone sculptures were discovered.

As for the sites located closer to the survey area, the existing literature describes clusters of archaeological
sites of different periods, localized in the Kyzylsu valley located just southwest of the Study Area. Kyzylsu
River is a left tributary of the Irtysh River and is characterized by a permanent character. This area will be
discussed in more detail in section 5.
4. PRESENCE / ABSENCE OF HISTORICAL AND CULTURAL HERITAGE SITES WITHIN THE SURVEY AREA
In August 2013 a request was sent to the East Kazakhstan regional institution for the protection of historical
and cultural heritage, the Department of Culture of EKO, accompanied by situational scheme of planned
territory to be surveyed, which was forwarded the above-mentioned public body in Zharma District Akimat
of which the answer was received about the availability of the survey area historical and cultural monuments
(Annex 3).
According to the response to our request, in the vicinity of Auezov village and Shalabai village there are 3
sites representing, according to the Akimat, historical and cultural value, of which only one is within the
Survey Area. Firstly, Bakyrshyk Kazhi’s seven-meter memorial is mentioned (discoverer of the deposit) set in
the center of Auezov in 2011. Secondly, it mentions the memorial, located in the village of Shalabai and
dedicated to the Great Patriotic War, erected in 1963. Thirdly it is told that there is a memorial in the valley
of the Kyzylsu River installed in 2003 in honor of Teristanbaly Nyman Kozhageldiuly Zharylgapov. Only the
first of these monuments is within the Survey Area, the second is removed from its outer perimeter of 2.5
kilometers (south-west), and the third is 18 kilometers from Shalabay rural district, that is at least 13 km
south of the outer perimeter of the Study Area. None of the three above-mentioned monuments are
mentioned in the list of state monuments of history and culture, respectively, representing some value only
according to the district authorities. In our opinion, all three of the monuments do not represent any
historical and cultural value.
The Area, the survey of which is provided in the terms of reference, for nearly six decades of industrial
development of the field has undergone strong anthropogenic influence, so the presence of its surviving
memorials relating to ancient history, was initially unlikely. In addition, directly in the area of BME location
there are no large rivers, on the banks of which the burial grounds and settlements of the Bronze Age, which
are widespread in the region, as well as archaeological sites related to later periods are often localized. The
nearest river (Kyzylsu) along which, according to the literature, there were earlier archaeological sites (more
on this point below), flows in one and a half and more kilometers to the southwest from the outer perimeter
of the Survey Area.
1. Almost in the center of the Survey Area (100 meters north of the Bakyrchik Mining Enterprise, in close
proximity to open pit №4) there is kind of a Muslim cemetery of Kudasov Matai, tentatively related to XIX -
XX centuries (wpt. Bakyrchik_cemetery1: 49°43'8.77"С, 81°35'5.29"В) the total area of about 50 square
meters, where he was buried, among other persons, whose names are listed on the days set out in our
gravestones, and also the legendary discoverer of Bakyrchik deposit - Bakyrshyk Kazhy Mamai Uly (1815-
1901). Grave fences are mostly made of stone, there is also a metal fence. A small monument (tombstone)
of Bakyrshyk Kazhy and second gravestone (wpt. Bakyrchik_monument: 49 ° 43'8.46 "C, 81 ° 35'4.73" B) were
installed near the cemetery (a few meters to the south-west) that were installed these days. Photos of the
cemetery are given in Annex 4.
There is information about the fact that the Management of BME attempted in the past to replace the
cemetery, as it is in place, which could be involved in the production process. However, despite the
attractiveness of the idea, the BME Management refused to do this because of the protests from local
residents. Despite the fact that this monument is located right in the center of the industrial area, it is
constantly visited and is of an iconic character for the local population, as evidenced by the multi-colored
ribbons and scarves on the branches of a bush that grows in the cemetery. In view of the above, in our opinion
(this view, as we consider, finds support among the local population), the grave of Bakyrshyk Kazhy (together
with all the surrounding cemetery and memorials set in the neighborhood) deserves to be set under state

protection as a memorial of history and culture. This will protect the property in the future, even if the owner
(user) of the Survey Area will be changed, and the views on the use of the land will be changed accordingly.
2. The study team has also examined the horizontal adit, whose entrance (wpt. Bakyrchik_gallery:
49°43'11.19"С, 81°36'7.05"В) is located on the northern slope of the western part of old open pit 2, now
flooded by groundwater. Photo galleries are given in Annex 5.
It is believed that this tunnel was developed in the second half of the XIX century, when artisanal gold mining
began at the deposit. The average dimensions of the tunnel is about 1.5 meters high, 1.2 meters wide, with
a length of about 21 metre with no branches. A piece of steel bracket found in the tunnel suggests that in
the past the tunnel was equipped with a wooden support, which is currently completely gone. Gallery itself
is often visited by the locals (which is confirmed by the presence of broken bottles, packs of cigarettes and
other signs of human presence). As far as we know, in the Kazakh (and also, for example, Russian) practice,
there have been no occasions of inclusion of such tunnels into the list of historical and cultural monuments.
In our opinion, it does not represent any historical and cultural value.
5. PRESENCE / ABSENCE OF HISTORICAL AND CULTURAL HERITAGE SITES AROUND THE SURVEY AREA
The following outlines the data obtained by the study team outside the Area defined in the client’s
requirements specifications. These data are provided for information only and may be relevant only in case
of Bakyrchik mine expansion in the future.
1. To the south perimeter of the survey area the study team found two Muslim cemeteries: Bura clan (wpt.
Bakyrchik_cemetery2: 49 ° 41'8.52 "N, 81 ° 36'17.52" E, located 800 meters from the outer perimeter of the
study Area) and Baki, Matai and Kudas-Matai clans (wpt. Bakyrchik_cemetery3: 49 ° 41'8.44 "N, 81 ° 36'53.15"
E, located 500 meters from the outer perimeter of the Area in the vicinity of the planned tailings pond in the
south-eastern part of the study area). Both cemeteries are characterized by a rather peculiar funerary
architecture and are estimated to XIX-XX centuries (there are also traces of installation of gravestones in
recent years). However, none of the names mentioned on the gravestones (neither old nor recent) have
significance in historical context. Besides, both burial sites are shown on old Soviet maps. As such, these
objects having been known for a long time, as well as to archaeologists, were not nevertheless included into
any lists of historical and cultural heritage sites. In our opinion, neither of the burial sites have any historical
or cultural value.
2. Approximately 7 km west-northwest of the outer perimeter, in Kyzylsu Valley, near the village of Ostrikova
(or Ostryakovka), according to the existing data (archaeological map of Semipalatinsk and East Kazakhstan
oblasts), there was once an accumulation of rock drawings. The study team examined the described
sandstone slates and detected no petroglyphs. The stones with rock art must have been either removed or
destroyed by weather and time.
3. The above mentioned archaeological map of Semipalatinsk and East Kazakhstan oblasts also shows a burial
mound with a stone embankment, once located southwest of the survey area (about 5-6 kilometres south
from its outer perimeter, in the area of today's Kyzylsu dam). However, at the time this map was drawn (late
forties - early fifties of the last century), there was no dirt road and water reservoir at this location, according
to available information. Therefore, during the period after the map was created the terrain had seen
significant changes. Preservedness of the burial mound was also checked by the study team and had not been
confirmed.
It should be noted that none of the objects in this section (as discovered and undiscovered) is mentioned in
the state list of monuments of history and culture, either of national or local level.
6. RECOMMENDATIONS

Thus, in response to the question raised in the terms of reference, we can say that based on the results of
the desk study and field surveys, no objects of historical and cultural value which could be included into the
state lists (national and local level) historical and cultural monuments have been detected within the
survey Area. This, in our opinion, is due mainly to the lack of large and stable sources of water in the study
area and decades of industrial development of the region (primarily these factors primarily influence the
presence or absence of archaeological sites, while monuments of architecture and urban planning depend
on this to a lesser extent).
However, it should be noted that the grave of Bakyrshyk Kazhy Mamai-Uly, the discoverer of Bakyrchik
deposit, (together with the rest of the surrounding cemetery and memorial erected nearby) deserves, in our
opinion, to be placed under state protection as a monument of history and culture, to put it more precisely,
as a monument of urban planning and architecture of local (regional) significance.
It should also be noted that if in the future, during industrial activities at the Bakyrchik mine site, other
objects, presumably representing historical and cultural value are found, these finds should be immediately
reported to the "East Kazakhstan Regional Institution for Protection of Historical and Cultural Heritage, of the
Department of Culture of East Kazakhstan Oblast. And in the future, according to the existing legislative
framework, archaeological sites located in the area of economic and industrial development, are subject to
mandatory scientific study.
